Terms of Service — Atar Bnia Messaging

These Terms of Service ("Terms") govern the use of the business-messaging services ("the Service") provided by Atar Bnia (אתר בניה), Israel ("we", "our"), including our Meta platform application "Atar Bnia Messaging".

1. The Service

The Service enables our business clients to connect their WhatsApp Business Account to our platform and to send transactional notifications (such as registration confirmations) to their own customers through the WhatsApp Business Platform, SMS, and email.

2. Client responsibilities

Business clients using the Service agree to:

  • Send messages only to recipients who gave explicit consent to receive them.
  • Use the Service for transactional, non-marketing communication unless the recipient explicitly agreed to receive other content.
  • Comply with the WhatsApp Business Terms of Service, Meta Platform Terms, and all applicable laws, including Israeli privacy and anti-spam regulations.
  • Provide accurate business information and keep their account credentials secure.

3. Acceptable use

The Service may not be used to send unlawful, misleading, harassing, or unsolicited bulk content. We may suspend or terminate access for violations of these Terms or of Meta's platform policies.

4. Data

Personal data processed through the Service is handled according to our Privacy Policy. Each business client remains the controller of its customers' data; we act as a processor on the client's behalf.

5. Availability and liability

The Service depends on third-party platforms (including Meta's WhatsApp Business Platform and SMS carriers). We do our best to keep the Service available but do not guarantee uninterrupted operation, and we are not liable for failures of third-party platforms. Our total liability in connection with the Service is limited to the fees paid to us for the Service in the preceding three months.

6. Changes

We may update these Terms from time to time; the current version will always be published at this address. Continued use of the Service constitutes acceptance of the updated Terms.

7. Governing law

These Terms are governed by the laws of the State of Israel, and the competent courts in Israel shall have exclusive jurisdiction.

תנאים אלה חלים על השימוש בשירותי ההודעות העסקיות של אתר בניה, לרבות אפליקציית "Atar Bnia Messaging". השירות מאפשר ללקוחות עסקיים לחבר את חשבון ה-WhatsApp Business שלהם ולשלוח הודעות תפעוליות (כגון אישורי הרשמה) ללקוחותיהם. הלקוח העסקי מתחייב לשלוח הודעות רק לנמענים שנתנו הסכמה מפורשת, בהתאם לתנאי WhatsApp ו-Meta ולדין הישראלי, ולהימנע מתוכן שיווקי ללא הסכמה או מתוכן אסור. מידע אישי מטופל בהתאם למדיניות הפרטיות; הלקוח העסקי הוא בעל השליטה במידע ואנו מעבדים אותו מטעמו. השירות תלוי בפלטפורמות צד שלישי ואיננו מתחייבים לזמינות רציפה; אחריותנו מוגבלת לדמי השירות ששולמו בשלושת החודשים האחרונים. על תנאים אלה יחול הדין הישראלי. יצירת קשר: roee@atarbnia.co.il
